In response to the recent court ruling which precludes enforcement of the RTRP requirements, the IRS has issued a statement acknowledging that tax preparers do not currently have to meet these requirements, which include registration, competency testing and continuing education.
The IRS is still confident that it has the authority to administer these regulations, and is working with the Department of Justice to determine the best way to proceed.
